Terms and Conditions of Use

1. Definitions and scope

These Terms govern access to and use of the BySEO platform, a SaaS service for website SEO management and optimization, provided by BySys di Enrico Fratipietro. Access is reserved for persons aged 18 or over.

2. Service description

BySEO provides tools for SEO analysis and optimization, including:

• Technical SEO analysis and structural audit
• Keyword ranking monitoring
• Google Search Console and GA4 integration
• AI-powered SEO autofix
• AI-generated SEO-optimized content
• Social media and competitor monitoring
• PDF SEO reports
• GEO (Generative Engine Optimization) modules

3. Registration

Registration requires a valid email and secure password, or Google OAuth authentication. The user is responsible for the confidentiality of credentials and all activities performed under their account. Transferring the account to third parties is prohibited.

4. Subscriptions and pricing

BySEO offers monthly or annual plans. Plans renew automatically unless explicitly cancelled through the Stripe portal in account settings. An additional credits system (wallet) is available for extra features; unused credits are non-refundable.

5. Payments and billing

Payments are processed by Stripe (PCI-DSS compliant). BySEO does not store credit card data. Prices are in Euro (€) inclusive of VAT where applicable. Electronic invoices are issued via Fiscozen based on the billing profile data provided by the user.

6. Right of withdrawal (consumers only)

Under D.Lgs. 206/2005, consumers may withdraw within 14 days of subscription.

Exception — immediate-access digital services: The right of withdrawal does not apply where the user has expressly consented to immediate service execution and the consequent loss of the right of withdrawal (Art. 59(o), D.Lgs. 206/2005). BySEO obtains this explicit consent during checkout: by accessing the platform immediately after payment, the user waives the right of withdrawal.

Professional users (B2B): The right of withdrawal does not apply. No partial refunds are provided for unused periods.

7. User obligations and responsibilities

The user undertakes not to:

• Use the Service for illegal activities, spam or infringement of third-party rights
• Attempt unauthorized access to platform systems
• Resell or sublicense the Service without written authorization
• Reverse-engineer the software
• Provide false data during registration or in the billing profile

8. Limitation of liability

BySEO is provided "as is". SEO data (rankings, traffic, estimates) are estimates and do not guarantee specific results. In no event shall BySys be liable for indirect, incidental or consequential damages. Maximum liability is limited to amounts paid in the last 12 months.

9. Intellectual property

The BySEO platform, source code, design and trademarks are the exclusive property of BySys di Enrico Fratipietro. User-generated content remains the user's property; the user grants BySys a limited license to process it for service delivery purposes.

10. Personal data protection

Data processing complies with GDPR. Under Art. 28 GDPR, BySys acts as Data Processor for data from sites managed by the user. For more information see our Privacy Policy.

11. Governing law and jurisdiction

These Terms are governed by Italian law. For B2B disputes, the Court of Campobasso has jurisdiction. For consumers, the Italian Consumer Code applies and the court of the consumer's residence has jurisdiction. For alternative dispute resolution: ec.europa.eu/consumers/odr.
